DEFINITIONS. The “Photographer” is Janicka Harris. The “Client” is any person, body of persons, firm, or Company with whom the Photographer or Consultant enters into an agreement for the sale of goods or provision of services by the Photographer.
PAYMENT. Due to the nature of custom photography, all sales are final. Janicka Photography or Janicka Harris Consulting guarantees that the portraits you receive meet the highest standards in every respect and works with clients to approve products, designs and custom work before and after orders are placed. Client must pay a non-refundable security deposit of $30 in order book their session. This is not an extra fee, but is deducted from the full sitting fee. Session fee is non-refundable should you cancel or due to inclement weather. It is non-transferable to another date in the event you wish to amend your booked session. The Photographer reserves the right to charge interest on all overdue invoices for services at $10 per day late. This applies to all web management services provided.
CONDUCT. The Client is responsible for the behavior of any persons accompanying them to an assignment. The Photographer reserves the right to terminate any assignment without notice if he deems the Client’s behavior to be unruly or unsafe. In such instances, the Photographer reserves the right to charge her full fees and expenses as described above of these Terms and Conditions. The Client will fully reimburse the Photographer or her agents for any loss/damage they cause to property or equipment.
CLIENT CONFIDENTIALITY. The Photographer will keep confidential and will not disclose to any third parties or make use of information communicated to him/her in confidence for the purposes of the photography. However, during product reviews, the Photographer may obtain external consulting from subject matter experts (e.g., professional local photographers, or advisers) that are reasonably necessary to enable the Photographer to carry out her obligations in relation to the commission. It will be certain that additional, personal information will not be shared with the external subject matter experts.
BOOKING POLICY. The client must book an appointment on via the Bookly Form. Click “Book Appointment” on the navigation bar.
CANCELLATION POLICY. Clients that cancel twenty-four (24) hours in advance will be charged an additional $50. This cancellation fee is in “addition to” the security deposit.
SESSION FEES. All prices are subject to change at any time without prior notice. Booking your session immediately guarantees the current portrait rates. Rescheduled sessions are subject to the prices current at the time of rescheduling. There will be $40 fee for each additional hour you will need the photographer’s service. The Photographer reserves the right to amend these Terms and Conditions without prior notice.
METHOD OF PAYMENT. The Photographer only accepts credit cards, cash or a money order. If you use a money order, make payable to “Janicka Harris”.
RUSH HOUR. A $50 rush fee will be charged for products needed in less than 14 days.
SCHEDULED EVENT (DAY OF). The Client and or other persons included in the portraits must be present on the day of the scheduled event and location. Persons who will not be included in the portraits do not need to be present at the scheduled event or location. The Photographer only need persons involved in the session to be on set.
SESSION PROOFS. Client will receive a proof gallery link within 2 to 4 weeks of their portrait session and after payment has been received. Photographer retains the right to edit the photographs and omit any image.
ONLINE PREVIEWING. Online portrait previewing at offers a convenient viewing method for “out of town” family and friends. I currently use this website for clients to view their password-protected or public galleries. The client will have the opportunity to view their photos and decide their favorites.
COMPLETION OF WORK. Work is complete when the photographer provides the client with agreed products purchased. This includes a CD, downloadable link (Google Drive), access to a web gallery, and or prints containing photos ordered by the client via the Client Portal. A “Print Ready” folder with the requested prints will be accessible to the client to print and order at their local print shop. All retouched or edited photos included in the session package will be ready for print with the appropriate sizing and dimensions. Not all photos received be resized for print.
RETOUCH, CONVERSIONALS, DIGITAL FILES. Finished prints are professionally retouched to remove any undesirable blemishes or body marks that clients may wish to have removed. Basic retouching includes mild blemish, stray hairs, and shadow removal. Complex retouching includes removal of scars or blemishes, and other visible, unwanted markings. Tonal conversions include converting color images to black-and-white or sepia tone (for a vintage or antique effect) and black-and-white images to sepia tone.
DELIVERY OF PRODUCTS AND SERVICES. The supply of products and services are provided by the Photographer on a best endeavors basis. The Photographer will not be liable for delays that are beyond her reasonable control. The Photographer shall use reasonable endeavors to meet agreed deadlines where applicable. Photographer undergoes a full review of photos for quality purposes and makes note of any photo inconsistencies/markings via PayPal prior to meeting with client to deliver the products. The Photographer shall not be liable for any delays in meeting any of her obligations which were due to causes beyond her reasonable control, including but not limited to; postage/courier/lab delays, war/acts of terrorism, riots, government legislation, industrial action, adverse weather conditions, acts of God, floods, fire, loss or damage in transit etc.
REFUND POLICY. No refund will be given under any circumstances if the client fails to attend the scheduled event on the day(s) agreed and at the time listed when the booking was made. No refunds will be provided for print or retouch services, unless photographer offers or deems it as necessary. If the photographer offers the client a refund, it will be in the form of cash, documented in PayPal as paid (back to the client), and sent to the client via email for their records. Refunds will be provided after Photographer reviews all products (e.g., electronic photos, prints) with client during the initial and or enhanced product review process.
